<p style="text-align: justify;"><strong><span style="color: #ff6600;">An Open Appeal to all Indians on the Occasion of the 68th Anniversary of India&#8217;s Republic Day 2017! </span></strong></p>
<p style="text-align: justify;">If We Really Stand For The Independent India, The Values of Democracy and Respect For Human Rights: &#8220;Observe The Republic Day of India 2017 As &#8216;Black Day&#8217;, on the following Crystal Clear Reasons:-</p>
<p style="text-align: justify;">Abu Dhabi crown prince, Sheikh Mohammed Bin Zayed Al Nahyan, is invited to be the chief guest of India&#8217;s Republic Day 2017. To add fuel to the fire the “UAE Army has also been invited to participate in the Republic Day Parade 2017&#8243; during which the chief guest will be the Crown Prince of Abu Dhabi.</p>
<p style="text-align: justify;">Mohammed Bin Zayed represents the UAE as the de facto ruler of UAE Federation. UAE is attributed to authoritarian regime with blood-stained hands, lacks accountability and total lack of judicial independence.  Any one who dares to criticize the regime risk arrest, torture, arbitrary detentions and enforced disappearance.</p>
<p style="text-align: justify;">The Army in question was trained by the notorious company once known as &#8216;BlackWater&#8217;, and recruited foreign mercenaries, originally intended to butcher their citizens who claim for democracy. The UAE is a member of Saudi-led ‘anti-terror’ coalition on which the Pakistani army chief [retired] Gen Raheel Sharif is the head.</p>
<p style="text-align: justify;">The UAE and its army both have proved by meddling its neighbouring countries that the victory of the people against any repressive regime in the Arab world is more dangerous than defeat!</p>
<p style="text-align: justify;"><strong><span style="color: #ff6600;">ENFORCEMENT OF LANDMARK UAE JUDGMENTS &#8211; &#8216;JABIR CASE&#8217;<br />
</span></strong><br />
Most importantly, there&#8217;s no respect for even the Judgments of the Supreme Court of that country. The UAE Federation is the worst wilful defaulter of the 4 consecutive Judgments passed against them by the Courts of Abu Dhabi in the most shocking and gruesome case of an Indian investor&#8217;. During the course of hearing the wrong-doers pleaded guilty ‘of their framing a false case against the Indian investor&#8217; to withdraw a civil lawsuit of a building contract.</p>
<p style="text-align: justify;">The Court of First Instance in Abu Dhabi, UAE, had specifically ordered investigation against their corrupt and conniving officials who looted money and valuables from the office of Indian investor.  The Full Bench of the Apex Court unanimously upheld the findings, precisely in line with the Lower Courts&#8217; Judgments.</p>
<p style="text-align: justify;">The UAE Federation did not comply with the Judicial directives of the Courts of Abu Dhabi. Instead, the Federation deliberately and maliciously deported him, the &#8216;Judgment Creditor&#8217;, from the UAE, denying him access even to his business assets spread over three establishments in Abu Dhabi, UAE, were worth One Hundred Million US Dollars  in 1995.</p>
<p style="text-align: justify;">This resulted his character assassination, leaving him in a whirl-pool of unimaginable mental trauma and thus the UAE Federation is accountable for its violation of Judicial decisions at first place.</p>
<p style="text-align: justify;">His claims against UAE were recognized by both the Supreme Court and the High Court of Delhi and ordered the Government of India to settle the case in two months, way back in 1997! All that is pending is the &#8216;execution of those Judgements, solely due to the inhuman approach of the concerned authorities representing both India and UAE.</p>
<p style="text-align: justify;">A vicarious liability exists under general law.  The violation of a specific directive of a Court of Law, renders the Abu Dhabi, UAE Federation, as a ‘Wilful Defaulter’, liable for the compensation due to the Petitioner, the &#8216;Judgment Creditor&#8217;.</p>
<p style="text-align: justify;">Under the above grave backgrounds, the Abu Dhabi crown prince cannot be made in a list of the distinguished chief guests of India&#8217;s Republic Day Celebrations. The Republic Day of India commemorates the date January 26, 1950, on which the Constitution of India came into force.</p>
<p style="text-align: justify;">Indians celebrated Republic Day all these years to strengthen the dynamics of a democratic values and to honour India’s great men and women who had sacrificed all the way.  We were quite fair so far, when we had distinguished personalities like Obama, Hollande etc., as our Chief Guests on our Republic Day ceremonies in the past.</p>
<p style="text-align: justify;">The &#8216;Judgment Creditor&#8217; is therefore soliciting your wholehearted support in his unique case to get Justice, in a portfolio of Landmark Judgments passed in absolute in his favour, by the highest Judiciary of Abu Dhabi and subsequent Judgments from Delhi High Court in the case, the benefits of which have been denied to him arbitrarily and inhumanly over an unduly long period of two decades, defeating all his relentless fight.</p>
<p style="text-align: justify;">The &#8216;Judgment Creditor&#8217; wishes to observe India&#8217;s Republic Day 2017 as a Black Day, in Protest Against the Non-enforcement of Legal Judgments&#8221; by both the Governments, the Government of UAE and the Government of India!</p>

<p style="text-align: justify;">Over the past year there have been a number of allegations in the United Arab Emirates (UAE) that authorities are torturing prisoners. <a href="http://www.hrw.org/news/2013/06/27/uae-reports-systematic-torture-jails" target="_hplink">Defendants</a> in a trial of political dissidents, three <a href="http://www.bbc.co.uk/news/uk-21517775" target="_hplink">Britons</a> held in Dubai and two <a href="http://www.hrw.org/news/2012/09/14/uae-enforced-disappearance-and-torture" target="_hplink">Syrians</a> have come out to say they have been tortured. Now, smuggled <a href="http://www.echr.org.uk/?p=904" target="_hplink">handwritten letters</a> by Egyptian prisoners facing trial over alleged Muslim Brotherhood links say that they have been tortured as well.</p>
<p style="text-align: justify;">The reaction from authorities has been to either ignore allegations or dismiss them as fantasy. This approach undermines the UAE&#8217;s commitment to the United Nations (UN) Convention Against Torture, which authorities signed up to in July 2012. In each case of alleged torture there has been an emphatic failure to conduct a thorough and impartial investigation.</p>
<p style="text-align: justify;">It is of grave concern that authorities in the UAE are being allowed to misappropriate a crucial treaty for the purposes of furthering a broadly positive international image. Shortly after signing up to the Convention Against Torture, the UAE <a href="http://www.un.org/en/ga/67/meetings/elections/hrc.shtml" target="_hplink">won a seat</a> on the UN Human Rights Council at the same time as Human Rights Watch were <a href="http://www.hrw.org/news/2012/09/14/uae-enforced-disappearance-and-torture" target="_hplink">reporting</a> on enforced disappearances and torture in the country. Whilst Emirati authorities fail to meet their obligations it is difficult to conclude anything other than their very public commitment to human rights is nothing but a public relations exercise.</p>
<p style="text-align: justify;"><a href="http://www.echr.org.uk/wp-content/uploads/2012/07/English-Translation1.pdf" target="_hplink">Handwritten letters</a> by Egyptian prisoners include allegations consistent with those made by others, with prisoners saying they have been subjected to beatings, electric shocks and exposed to extremes of temperature in solitary confinement. Prisoners say guards have threatened them with HIV infection, sexual abuse and death while revealing that when they complain to the prosecutor, he has threatened them with further torture if they do not admit the charges against them.</p>
<p style="text-align: justify;">The trial of these Egyptians is <a href="http://gulfnews.com/in-focus/uae-security-trial/egyptian-emirati-muslim-brotherhood-cell-trial-set-1.1241305" target="_hplink">due to start</a> on November 5th, when defendants will face charges of illegally establishing a branch of the Muslim Brotherhood in the UAE. It is crucial that authorities address these allegations prior to trial, otherwise the process will have little credibility. Authorities must approach this with impartiality in line with <a href="http://www.ohchr.org/EN/ProfessionalInterest/Pages/CAT.aspx" target="_hplink">Article 12 </a>of the Convention Against Torture, which requires an investigation wherever there is reasonable ground to believe an act of torture has been committed.</p>
<p style="text-align: justify;">Concerns about the fairness of a trial for the Egyptians have been raised with the release of a <a href="http://www.icj.org/united-arab-emirates-amidst-crackdown-on-political-reform-advocates-icj-documents-massive-rights-violations-in-the-uae-94-trial/" target="_hplink">report</a> by the International Commission of Jurists that described a similar trial, that of the UAE 94, as &#8216;manifestly unfair&#8217;. It should be noted that of the 61 men currently serving prison sentences from that trial, 20 of them are on <a href="http://www.echr.org.uk/?p=843" target="_hplink">hunger strike</a> protesting against alleged mistreatment by prison authorities.</p>
<p style="text-align: justify;">The link between the UAE 94 and the trial of the Egyptians is clear to see. Both groups are accused of conspiratorial Muslim Brotherhood activities, which is the bogeyman of the day for Emirati authorities when dealing with political opponents. Indeed, the role of the UAE in Egypt&#8217;s military coup has been called into question following an <a href="http://www.middleeastmonitor.com/news/africa/7315-ahmed-shafiq-interview-reveals-uaes-role-in-egypts-massacres" target="_hplink">interview</a> with Ahmed Shafiq in which the former Egyptian Prime Minister admitted the UAE had given weapons to the Egyptian army prior to the massacres at Rabaa al-Adawiyya and Al Nahda.</p>
<p style="text-align: justify;">There is a clear disconnect between the commitment to protect human rights made by the UAE and the reality of their actions in dealing with a political group they dislike and citizens who call for democratic reforms. Authorities have committed to preventing torture and sit on the Human Rights Council, yet fail to uphold their treaty obligations and openly <a href="http://twocircles.net/2013aug15/uae_concerned_over_situation_egypt.html" target="_hplink">support</a> massacres by the army in Egypt.</p>
<p style="text-align: justify;">At the heart of the issue here are human stories. The Sonbol family of Egypt is a tragic case in point. Ali Sonbol is an Egyptian who was arrested in the UAE on December 19th 2012 and is accused of illegal Muslim Brotherhood activities. He claims to have been severely beaten by prison guards, leaving him with a number of serious injuries. Tragically, Ali Sonbol&#8217;s 24-year-old son was <a href="http://www.thenational.ae/news/uae-news/journalist-one-of-two-young-uae-residents-killed-in-cairo" target="_hplink">killed</a> in the massacre at Rabaa al-Awawiyya in August. Given that Ali Sonbol is being held at a secret prison it is unclear if he knows his son has been murdered. This family has suffered the full brunt of the UAE&#8217;s policies in aggressively attacking anyone associated with the Muslim Brotherhood.</p>
<p style="text-align: justify;">It is a sad state of affairs when a country is allowed to, quite clearly, abuse the just cause of protecting human rights. For the Convention Against Torture and Human Rights Council to be effective it is vital that the UAE are demanded to investigate all credible allegations of torture. This includes the case of the Egyptian prisoners, the UAE 94, the three Britons and that of the two Syrians. Until that happens, the UAE are being allowed to make a mockery of the international protection of human rights with families like the Sonbols left to suffer the horrific consequences.<br />

Western diplomats here said they believed the Emiratis were privately urging the Egyptian security forces to crack down the supporters of ousted President Mohamed Mursi, that killed hundreds of people, when authorities forcibly broke up protest camps.</p>
<p style="text-align: justify;">&#8220;Western governments took a wait-and-see approach even after the military committed its first mass killing, shooting more than 60 supporters of Mr. Morsi at a sit-in on July 8. Western diplomats did not engage in earnest until July 24, when General Sisi, in dark sunglasses and military regalia, delivered a fiery speech asking the public to turn out for demonstrations giving him a “mandate” to take on the Islamists. Security forces killed 80 more Morsi supporters in their second mass shooting on the day of the demonstration.</p>
<p style="text-align: justify;">The next morning, Morsi aides and Brotherhood leaders say, their phones began ringing with American and European diplomats fearing an imminent blood bath.</p>
<p style="text-align: justify;">The administration enlisted people on opposite sides of the contest unfolding in Egypt. Diplomats from Qatar, a regional patron of the Muslim Brotherhood, agreed to influence the Islamists. The United Arab Emirates, determined opponents of the Islamists, were brought in to help reach out to the new authorities.</p>
<p style="text-align: justify;">But while the Qataris and Emiratis talked about “reconciliation” in front of the Americans, Western diplomats here said they believed the Emiratis were privately urging the Egyptian security forces to crack down.</p>
<p style="text-align: justify;">Abdullah bin Zayed al-Nahyan, the Emirati foreign minister, went to Washington last month and urged the Americans not to cut off aid. The emirates, along with Saudi Arabia, had swiftly supported the military takeover with a pledge of billions of dollars, undermining Western threats to cut off critical loans or aid.</p>
<p style="text-align: justify;">The Israelis, whose military had close ties to General Sisi from his former post as head of military intelligence, were supporting the takeover as well. Western diplomats say that General Sisi and his circle appeared to be in heavy communication with Israeli colleagues, and the diplomats believed the Israelis were also undercutting the Western message by reassuring the Egyptians not to worry about American threats to cut off aid.</p>
<p style="text-align: justify;">Israeli officials deny having reassured Egypt about the aid, but acknowledge having lobbied Washington to protect it.</p>
<p style="text-align: justify;">When Senator Rand Paul, Republican of Kentucky, proposed an amendment halting military aid to Egypt, the influential American Israel Public Affairs Committee sent a letter to senators on July 31 opposing it, saying it “could increase instability in Egypt and undermine important U.S. interests and negatively impact our Israeli ally.” Statements from influential lawmakers echoed the letter, and the Senate defeated the measure, 86 to 13, later that day&#8221;.</p>
